These Terms & Conditions ("Terms") govern your access to and use of the Fit'n'Well Hub website, mobile experience and related services (the "Platform"), operated from Australia. By creating an account, listing services or making a booking you agree to be bound by these Terms.
1. Who we are
Fit'n'Well Hub is an Australian-owned online marketplace that connects clients ("Clients") with independent wellness, fitness, health and beauty practitioners ("Providers"). We are not a healthcare provider and do not deliver any treatment, class or service ourselves.
2. Eligibility & accounts
You must be at least 18 years old (or have a parent/guardian acting for you) and able to enter a binding contract under Australian law. You are responsible for keeping your login credentials secure and for all activity on your account. Notify us immediately at support@fitnwellhub.com if you suspect unauthorised use.
3. Bookings are between you and the Provider
Every booking is a direct contract between the Client and the Provider. Fit'n'Well Hub facilitates discovery, scheduling and payment but is not a party to the service delivered, does not endorse any Provider, and makes no warranty about treatment outcomes.
4. Payments, fees & commissions
All payments are processed by Stripe. Subscription fees and per-booking commissions are disclosed on our Pricing page and at signup, including:
- Starter (free monthly): 5% commission per completed booking, charged 24 hours before the appointment. No commission if you have no live services.
- Professional ($29/mo or $290/yr): 0% commission per booking.
- Studio ($49/mo or $490/yr): 0% commission per booking. Founding offer: 3 months free, then automatic billing.
All amounts are in AUD and include GST where applicable. Failed payments may suspend access until resolved.
5. Cancellations & refunds
Refunds, cancellations and no-show charges are governed by our Refund & Cancellation Policy, which forms part of these Terms. Nothing in these Terms limits your rights under the Australian Consumer Law.
6. Provider obligations
Providers must (a) hold all qualifications, registrations, licences and insurances required to deliver their services in Australia; (b) comply with Australian Health Practitioner Regulation Agency (AHPRA), Therapeutic Goods Administration (TGA) and state-level laws as applicable; (c) issue compliant tax invoices including for NDIS where relevant; and (d) keep their availability, pricing and service descriptions accurate.
7. Client obligations
Clients agree to provide accurate information at booking, to disclose any health condition that may affect the safety of a service, to arrive on time, and to behave respectfully toward Providers and staff. Discriminatory, threatening or abusive behaviour may result in immediate suspension.
8. Acceptable use
You must not (a) post false, misleading or unlawful content; (b) scrape, reverse engineer or interfere with the Platform; (c) attempt to circumvent booking fees by taking bookings off-platform after introduction; (d) misuse personal data of Clients or other Providers; or (e) impersonate any person.
9. Reviews
Reviews must reflect genuine experience. We may remove reviews that are defamatory, misleading, contain personal data or are posted in exchange for incentives.
10. Intellectual property
The Platform, including its design, code and content, is owned by Fit'n'Well Hub and licensors. By uploading content you grant us a non-exclusive, worldwide, royalty-free licence to host, display and promote that content in connection with the Platform.
11. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Where we are permitted to limit our liability, we do so to the maximum extent allowed. Nothing in these Terms excludes consumer guarantees that apply to you as a "consumer" under the ACL.
12. Limitation of liability
To the maximum extent permitted by law, Fit'n'Well Hub is not liable for (a) the acts or omissions of any Provider or Client; (b) loss or damage arising from a service booked through the Platform; or (c) indirect, consequential or special loss. Our aggregate liability to you for any claim is limited to the fees you paid us in the 12 months before the claim.
13. Suspension & termination
We may suspend or terminate accounts that breach these Terms, pose a safety risk or expose us to legal liability. You may close your account at any time from your dashboard.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales.
15. Changes
We may update these Terms from time to time. Material changes will be notified by email or in-app at least 14 days before they take effect.
